2. Services description

Pingo Pay provides payment infrastructure, including multi-currency accounts, corporate cards, money transfers, merchant acquiring, and developer APIs. Features and availability may vary by jurisdiction and account type.

3. Account registration

To use certain Services, you must register an account and complete identity verification. You agree to provide accurate, complete, and up-to-date information and to keep your account credentials secure. You are responsible for all activity that occurs under your account.

4. Acceptable use

You may not use our Services for illegal activities, fraud, money laundering, sanctions evasion, or any purpose that violates applicable laws or regulations. We reserve the right to suspend or terminate accounts that violate these rules.

5. Fees and payments

Fees for using our Services are described on our Pricing page and in your account agreement. We may change our fees from time to time with reasonable notice. You are responsible for all applicable taxes.

6. Risk disclosures

Payment services involve risks, including currency fluctuation, transaction delays, and regulatory changes. Pingo Pay is not responsible for losses caused by factors outside our reasonable control, including but not limited to bank failures, network outages, or force majeure events.

7. Intellectual property

All content, trademarks, logos, software, and other materials available through our Services are owned by Pingo Pay or our licensors and are protected by intellectual property laws. You may not reproduce, modify, or distribute them without our prior written consent.

8. Limitation of liability

To the fullest extent permitted by law, Pingo Pay shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or related to your use of the Services. Our total liability shall not exceed the fees you paid to us in the twelve months preceding the claim.

9. Indemnification

You agree to indemnify and hold harmless Pingo Pay and its officers, directors, employees, and agents from any claims, damages, or expenses arising from your use of the Services or violation of these Terms.

10. Termination

Either party may terminate the agreement at any time. We may suspend or terminate your access to the Services immediately if you breach these Terms or if required by law. Upon termination, your right to use the Services ceases immediately.

11. Governing law

These Terms are governed by the laws of the Province of British Columbia and the federal laws of Canada applicable therein. Any disputes will be resolved in the courts located in Victoria, British Columbia.

12. Changes to terms

We may modify these Terms from time to time. We will post the updated Terms on our website with a revised effective date. Your continued use of the Services after changes constitutes acceptance of the revised Terms.
